Terms of Sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

In order to contract with Maryvonne Wellen Jewellery you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. maryvonnewellen.com retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with.  When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

(a) Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

(b) Availability and order options

Maryvonne Wellen Jewellery can not guarantee that all items included in the Maryvonne Wellen Jewellery webshop are in stock at the time of your order. Since we would still like to offer you the possibility to order the piece of your liking, we now added the ‘made to order’ option to our webshop

Made to order; the requested piece is out of stock at the moment. When choosing this option, we start creating your product as soon as possible after we’ve received your order. Of course we’ll let you know how long it will take us to deliver it to your door.

(c) Pricing and Payment

The prices stated on the Maryvonne Wellen Jewellery online-shop are in EURO. Shipping costs are not included. The prices are given with reservation for increased supplier prices, printing errors and any incorrect stated specifications. All prices in the order confirmation are stated in Euro and include applicable VAT and any other taxes, delivery costs and potential C.O.D fees. Purchasing Product(s) from countries outside of Germany may also constitute payment of customs duties, which are not included in the price(s). Any customs duties payable shall be paid by the Customer to the customs or other relevant authorities in the country where the Product(s) is/are finally delivered.

Upon receiving your order we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorisation being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. All Products shall remain the property of Maryvonne Wellen jewellery until full payment has been made. The price applicable is that set at the date on which you place your order.  Once the goods have been despatched and you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email.

All transfers conducted through Maryvonne Wellen Jewellery are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway choosen for the transaction as they are responsible for the transactions made.

(d) Force majeure

In case of Force Majeure, Maryvonne Wellen Jewellery´s obligations will be suspended. The contract between you and Maryvonne Wellen Jewellery can, in such cases, be partially or fully terminated by yourself or by Maryvonne Wellen Jewellery. A Force Majeure is in the event of war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. Under such circumstances, Maryvonne Wellen Jewellery will attempt to resolve all issues in a timely manner.

(e) Delivery and shipping

Your order is usually shipped within 3-5 business days after we received your payment, not including special or custom made products that may take longer or where a longer delivery period is mentioned in the product description. Orders are processed Wednesday to Saterday 11am-6pm, not including holidays, pending payment authorization and verification.

We ship our jewelry covered by insurance with Deutsche Post/DHL. Depending on your destination it will be delivered by your local mail. The tracking number we provide you, is a tracking number by German mail. Usually this tracking number changes in the recipient country.
Please note that the delivery period within Europe is approx. 4-7 business days and for worldwide shipping depending on the destination from 7-14 business days.
We always recommend to order as soon as possible. Please make sure your address is correct and that somebody is present at this address to take your delivery, otherwise please mark an alternative address.

Delivery costs will be charged according to order value and destination as per particulars given below. It can happen that for some deliveries abroad additional customs duty will be charged.

If the package is not picked up by the customer and any kind of fee is added, the customer is responsible for the extra cost and will be charged all costs and expenses associated with the return-shipment. This includes freight charges, any extra payments, duties, taxes, levies, fees for DSV prepayments, return charges, any additional fees, etc.

(f) Return policy

If you received your order and aren’t totally satisfied with the product, you are welcome to return it within 15 days of receipt on all unworn jewelry for a refund less shipping (if applicable), to the original method of payment. Items must be returned with original packaging in perfect condition. They are to be unused other than for the purpose of trying on for fit. If there is evidence to suggest that the goods have been used to a degree such as to decrease the value of the product, the customer loses his/her right to exercise a return.

Disclaimer of Liability

The contents of our pages have been created with the utmost care. Nonetheless, we cannot guarantee the contents’ accuracy, completeness or topicality.
